Action taken against PMIUM and UM students
This is really sad. Another reason why the UUCA should be revised. These students were not taking part in political activities. They merely invited politicians, some of whom happened to be from the opposition party, to some of their events. Sadly, the provisions of the amended UUCA probably can be interpreted in such a way as to make a case for these students to be punished.

What else is new in the land of 1Bolehland, the fantasy democracy nation ( the only 1 in the world, mind you).
I suppose if the Times Higher Education Supplement ranking of the world's top universities take into account "academic freedom" and "free speech" on campus,
UM will no longer appear on its
Top 200 (or even Top 300) radar screen.

When you study in institutions run by racist assholes of a particular race be smart. Firstly, understand that they do not want you 'pendatangs' there in the first place. You people ARE seen as taking away their rightful opportunities and impinging upon their 'ketuanan' rights. Here are the things you must do to fight this racist shit.
1. Encourage as many people as possible to apply for places in public universities. Shed tears and roll on the floor in front of the world if they refuse you on unfair grounds. YOUTUBE anyone?
2. For those about to enter these institutions and those who are already there. Learn to speak and write Malay well. To beat your enemies you must learn how to use the same tools they use to oppress you. At the same time make sure your command of your mother tongue and English is as good as possible. You will see why in a moment.
3. Make friends with the Malays. Try very hard. You will not believe how many Malays HATE UMNO and even PAS for they were also discriminated against for their views of the Malays.
4. After you graduate, look for a job in Singapore because Singapore companies like to hire Malaysian graduates. SINGAPOREAN EMPLOYERS DO NOT HIRE MALAYSIANS DUE TO RACIAL CONSIDERATIONS. Like any other employer they are stingy calculating machines. They like us because we are willing to work harder, get paid less than local Singaporeans and we are MULTILINGUAL in a way 95% of Singaporeans are not. Being multi-lingual allows you to multi-task in a way no mono-lingual, or even bi-lingual can. Most importantly we will value our jobs for we will NEVER get such jobs in Malaysia at the pay level in Singapore. As a general rule of thumb you get paid about three times more in ringgit terms for the a job in Singapore compared to similar jobs in Malaysia. My friend used to earn RM6000 a month working for ST Microelectronics now he is drawing RM16,000 a month not counting profit sharing at Infineon.
5. When you have accumulated some money and you think of being a towkay. This is where all your Malay friends will be able to help you in Malaysia and even Indonesia. The Singapore business environment is very tough on small entrepreneurs for it is dominated heavily by big business. The strategy here is to use Singapore to collect enough resources so that you can come back to Malaysia own property do business and have the best of both worlds.
6. Spit on 'Ketuanan Melayu' and they will still roll out the red carpet for you as they are doing in the Iskandar Project in Johor.
7. I studied overseas and worked a long time ago. Our ability to operate in various languages never cease to amaze the whites. Be multi-lingual and kill their 'ketuanan' shit
It does suprise me why the Whites gave UM 180 place when it is them that professes and preaches human rights on a grand scale. When you go for their interview and when you are not Malay, you get the cold shoulder and subtle racial insults thrown your way. It is not suprising that they are treating their students in this same manner.
'When you go for their interview and when you are not Malay, you get the cold shoulder and subtle racial insults thrown your way.' See what I mean when I say these racist bastards do not want non-Malays there. Matters not. Go for the interview anyway and wait for the day when you can spit on their 'Ketuanan' shit.
Vinnan...I'm not surprised you were given the cold shoulder...based on your attitude and your language...I wouldn't want any of my children study under you
'Vinnan...I'm not surprised you were given the cold shoulder...based on your attitude and your language...I wouldn't want any of my children study under you'
Listen I am not a teacher who has to toe the propaganda nonsense of the government over how this 'apartheid' is a part of the 'social contract' which the government conjured from thin air. Nowhere in the talks between the various parties leading up to independence was this phrase ever used. This 'social contract' came later as a way to justify the apartheid system in Malaysia.
I am telling ALL non-Malays a very simple truth. The racist Malays/UMNO have no intention of accepting the non-Malays as part and parcel of Malaysia. They PURPOSELY devise a system to make the lives of the nons as hard as possible so as to make the nons leave Malaysia in search of a better life. I am telling all non-Malays there is an alternative. The answer lies in being multi-lingual and Singapore. Make enough money to buy their country. They will sell. Why do you think the British came up with the Malay Reserve Enactment in Malaysia?
Understand this. UMNO has declared war on the nons and their intention is to drive out all the nons from Malaysia without having to set the country on fire. The nons must respond by playing on the one thing UMNO can never control. GREED.
Dear Mr Vinnan
My take on this.
In any society, the racists are the minority. The people of goodwill who want to live in harmony are the majority. Plenty of good people from the Malay Malaysian community who oppose the UMNO-BN kleptocracy.
Otherwise, why would they get into a frenzy over the PKR and PAS alliance with DAP? YB Teresa Kok even got a piece of hate mail/death threat over her mention of a DAP branch consisting of many Malays in Ampang.
We don't have to be like them (i.e. the racists and fascists who seem to be taking over UMNO) and their other BN partners in the kleptocracy.
We reject their racism and rank opportunism, we believe in opportunity for all (coupled with affirmative action for all poor people from all the different Malaysian communities. This will especially benefit our poor Malay brothers and sisters who form the majority of the poor. And the Orang Asli and East Malaysian native poor too -- poverty-stricken, malnourished, diseased, even raped with what seems like impunity).
I'm working to promote social democracy in Malaysia and I trust you are in this project too.
Phua Kai Lit
Vinnan, please read the Malaysian Constitution especially Article 153and understand fully its content. Your forefathers had the option of returning to their country of origin during the negotiation for independence . The Malay sultans had no intention to give citizenship to migrant workers brought in the British to work in the tin mines and rubber estates owned by the British. The Malay sultans were persuaded to agree to give the migrant workers Malayan citizenship during the negotiation for independence. In return the negotiating parties namely the Malay sultans, UMNO,MCA,and MIC and the British have agreed to incorporate Article 153 into the Malayan Constitution. That's a fact. Luckily, they had the foresight of putting thir agreement in writing and ingrained into the highest law of the land ,that is the Malayan Constitution. No country in the world would readily offer migrant workers as citizen as the Malays. There are a lot of foreigners in Dubai, do you think Arabs would easily grant citizenship to the migrant workers that flocked to their country? Be grateful for what you have in this country. Be a good citizen not like your HINDRAF brothers.
I think it is sometimes worth watching the rest of the world in perspective before commenting. I agree that we need to put pressure on government to make those changes that encourage performancce and merit rather than race.
Take a look at tv australia blog for educaiton and its dangers:
Nowhere in article 153 does it say non-Malays must be discriminated against. Malay rights are to be protected but not at the expense of the nons. This is the real 'social contract' which UMNO have subverted with their 'Ketuanan' shit for their own selfish interest. Show me the specific article which says discrimination against the nons is to be carried out in the name of Malay rights. It was the sacrifice of a truly Malaysian society at the altar of Malay racism who prompted Onn Jaafar to leave UMNO.
Do not give me the nonsense about how generous the Malays were in granting the nons citizenship. UMNO knew it had no choice but to allow the nons to be incorporated into Malaya so as to counter the influence of the communist among the nons. At the same time it needed to counter the left wing Malays who saw UMNO as nothing but a Western stooge. Article 153 was the weapon to kill the left-wing in Malay society and to turn UMNO into Malay heroes.
NO ONE in politics do anything without protecting or enhancing ones political interest, least of all UMNO. The clearest example is how UMNO still retains it colonial acronym UMNO for all the Bahasa Jiwa Bangsa heroics simply because it is UMNO's most easily recognised acronym. Pick any corner of the CBD in Kuala Lumpur and do a take on the number of Malays sitting in the backs of the luxury cars. The Malays easily make up three quarters of these rich people. Furthermore, 99% of these Malays are in one way or another linked to UMNO companies. You can refuse to change your racist shit but you will never stop us from questioning it and telling the whole world how Malaysia is the only country left in the world run on apartheid principles. we can survive without UMNO's help and we will beat UMNO in the world arena.
By the way all of Malaysia now knows you HINDRAF have been bought over by UMNO.
You are right no where in Article 153 says the non-Malays must be discriminated and I never said that. Do you think the non-Bumi were discriminated? Prove to me that non-Bumi iare being discriminated. Are they being prevented from schooling? Are they being prevented from doing business? There shouldn't have any vernacular schools as it is against the Constitution which states that only Bahasa Melayu shall be the national language of the country. It means that there should be only national medium school though other languages can be taught in national schools. In fact, I think the Malay government had been too soft on its migrant new citizens. They should have imposed assimilation policies like the Indonesian goverment did on non-pribumi citizens like no Chinese names, no Chinese can be spoken or taught and they can speak only Indonesian. Because of these policies, the Chinese became very loyal citizen of Indonesia unlike ethnic Indians and Chinese in Malaysia. Most Indian and Chinese Malaysians CANNOT speak Bahasa Melayu fluently like the Malays do when Bahasa Melayu is the national language. At most these people which claim to be citizens can only speak pasar Malay or the educated ones speak book Malay which sounds very artificial.
During the independence negotiation, had the Malay rulers known that the offsprings of the new citizens would renege on agreement, they would not have agreed to grant citizenship to the Indians and Chinese. The Malays would have fought the independence by themselves. The Indonesians proved that without any assistance.
Hardline Malays reject pluralism at their own peril - and, unfortunately, also at the peril of their much more numerous, accepting bretheren. Someone should note how low the average living standards of Indonesia was. (Also note how they're getting better at a considerable pace now that they largely abandoned the ideological trash and got a lot more utilitarian and pluralist.)
True, which should get rid of all the ideological trash and go to the same schools and speak the national language
Coltz, Malays do not reject pluralism. If they had, there wouldn't be any Chinese or Indians at all in Malaysia. All that the Malays want is for all citizens to respect the Malay special privilege as enshrined in the Constitution and to respect the Rukun Negara.
As for the conditions in Indonesia, being a large nation of 240 million just like China and India it is not easy to manage.China imposed communist ideologies to control its 1.2 billion population without which the people would be fighting all the time as in India.
The Indonesian had suffered under the dictatorship regime of Suharto. Suharto only provided for his families and cronies while failing to develop country. Now that there are no longer any dictators in Indonesia things are moving quite smoothly. They are presently experimenting with absolute free press. Look at what absolute free press has produced. The current spat of ill-feelings between some Indonesians and Malaysians is the result of the Indonesian free press which have irresponsibly created false news to harbour hate between the two nations. So, the low standard of living in Indonesia is not due their assimilation policies. Instead it has strengthened the country's nationalism as proven in the current spate of ill-feelings between Indonesians (which includes Chinese Indonesians)and Malaysians.
The only thing that can be add to this saga is --- It's a blessing in disguise.
Those six students ought to go out of this hell hole, see the world out there, and realize how silly and petty UM is.
Coltz, Malays do not reject pluralism. If they had, there wouldn't be any Chinese or Indians at all in Malaysia.
The Chinese and Indians were here in Malaysia long before there was special privileges were mooted as an idea. The Chinese and Indians were here long before Malaysia was an independent Federal country.
Sultan went to Ming China himself to ask to be a Vessel State of China and invited the Chinese to be part of the Sultanate. In this way, the Chinese is equal to Malays in not superior with special rights as China is the "overlord" by the request of the Malay Sultan. Check this with any world historian.
But the Chinese cannot be superior to Malays. And must not be. Because Chinese recognise Malays and Indians as brothers together in building up this nation. We want to work with everyone on same ground. But who is the one who keeps asking for "special" treatment?
The Malays do not reject pluralism. This I agree. But the racist parties and their "special rights" policies are against pluarlism.
You are confusing with the small number of Chinese who came to Malacca with Admiral Cheng Ho during the period of Malacca sultanate and the present group of Chinese who are mainly descendants of the migrant workers from China brought in by the British to work in the tin mines. The earlier group are now your Babas and Nyonyas which have sort of assimilated the Malay cultures while the latter has not.
Similarly, the Indians that came earlier have assimilated into the Malay society not the group brought in by the British to work in the rubber estates. The former is your present mamak group from Penang.
The group in question now is the migrant workers brought in by the British.
Please do not confuse yourself with Malaysian history.
"All that the Malays want is for all citizens to respect the Malay special privilege as enshrined in the Constitution and to respect the Rukun Negara."
Really, I hear "go back to Tiongsan" or "go back to India" chants all the time. Not from streetside madmen, mind you, but from seemingly respectable people in UMNO youth. You know, with hundreds of people cheering in the background.
"Look at what absolute free press has produced. The current spat of ill-feelings between some Indonesians and Malaysians is the result of the Indonesian free press which have irresponsibly created false news to harbour hate between the two nations."
Know your Konfrontasi history, those "ill-feelings" ran a long way.
"Instead it has strengthened the country's nationalism as proven in the current spate of ill-feelings between Indonesians (which includes Chinese Indonesians)..."
You mean those who did not run away during the world-famous racial riots against fully "assimilated" members of the nation who ditched their ancestral names to show their sincerity.
By the way, I keep hearing this argument that "giving this race priviledge" is not equal to "discriminating against other races". Wake up, this does not make any sense. The most applicable definition of "discriminate" from Random House:
" to make a distinction in favor of or against a person or thing on the basis of the group, class, or category to which the person or thing belongs rather than according to actual merit"
If giving the Malays priviledge based on their race and skin color instead of any merit/socioeconomic status is not discriminating against other races, it'll be a really intriguing strip of the original meaning. The line is in the Constitution, so be it, it is then a Constitutional discrimination. You could argue that the Constitution mandates such a discrimination, but please do not try to redress it as anything nicer, it's disingenuous.
Coltz, why is it you keep on confusing your facts? The current spat with Indonesia has nothing to do with Konfrantasi days which was Sukarno's war cry to create the Indonesia Raya (the Greater Indonesia)which would have included Malaya,Brunei and Singapore which basically the Malay Archipelago to take advantage of the withdrawal of Britain from this region.Sukarno gave the excuse that Tunku tried to annex Kalimantan to justify the Indonesian nationalism spirit when there were no such thing. On the current spat , there are no such overtures from Indonesia . The Indonesian media could have been manipulated by certain group to embarrass SBY who was recently re-elected President.
If you have been to Jakarta often enough, you'll realise these demonstrations are normal occurence in the city. Usually done by university students out for a few thousand rupiahs paid by certain interest groups.
Your knowledge on current affairs seems much left to be desired . What more on regional history.
You are confusing with the small number of Chinese who came to Malacca with Admiral Cheng Ho during the period of Malacca sultanate
I am not. Explain Bukit China. These are before Cheng Ho. Explain the Chinese Schools governed then by the Qing China education system. Explain the Chinese BUSINESSMEN whom were UMNO's main "pets" in pushing for "special rights".
Labourers? You sure know how to try make other people look bad, without looking at history proper, while shaming your own UMNO main reason for "wealth distribution".
The Indonesian Chinese had been assimilated into Malay culture.Unfortunately, racial riots still broke out.Maybe because the Chinese hardly accept the culture of laziness and hence work harder ,resulting in the jealousy of other race.
The Indonesia Government has now admitted their mistakes and allowed Chinese schools to be built. Of course, there are still some disobedient officers who still discriminate against the Chinese.
For Malaysia, only the first prime minister ,the Tunku ,tried hard to be fair to all races.I do not know what negotiation between him and Chinese leaders. The Tunku did not want to implement any policies that favoured the Malays.
Citizenship in exchange for special rights is an insult to citizenship.Citizenship demands loaylty to a nation.
The Chinese actually got their citizenship because of their fight against the Japanese. This was a promise given by the British. And then the British gave citizenship to some Chinese again so that they would not support communist.Dato Onn even threatened to give up the post of UMNO President if the Malays opposed Chinese getting citizenship.
And Bumiputera ,please do not point finger to Chinese again. One former prime minister had said 70% to 90% of income tax was paid by the Chinese.Yet the government policies still favours the majority race.In other countries, special rights are usually given to minority instead of majority.
Bro, you are terribly confused.
I think you have been successfully brainwashed by the DAP into confusing your facts.
Here are the facts:
Close relationship between the Chinese kingdom and the Malacca sultanate was established in early 15th century during the reign of Parameswara when Admiral Zheng He(Cheng Ho), a Chinese Muslim visited Malacca. He probably left some of his followers in Malacca to enhance the relationship.
In 1459, the Emperor of China sent a princess, Hang Li Poh and her entourage to the Sultan of Malacca as a token of appreciation of their diplomatic relationship. The entourage then set up their first settlement in Bukit China,Malacca and stayed there until the Portuguese invaded in 1511.
So, you see Bukit China came even later than the visit by Admiral Cheng Ho. And all these people were diplomatic representatives of the Chinese Emperor unlike the economic migrants brought in by the British in mid 19th century to work at the tin mines.
I don't understand what you mean by 'the Chinese Schools governed then by the Qing China education system'? The Malacca sultanate or Malaya were never a colony of China.
Again, I don't understand what do you mean by 'the Chinese BUSINESSMEN whom were UMNO's main "pets" in pushing for "special rights".'
Get proper facts and argue .Not with some muddled piece of information.

Prove to me of your statement 'The Chinese actually got their citizenship because of their fight against the Japanese. This was a promise given by the British. And then the British gave citizenship to some Chinese again so that they would not support communist.Dato Onn even threatened to give up the post of UMNO President if the Malays opposed Chinese getting citizenship.'

I've the evidence to prove that special privilege of the Malays in return for citizenship for Chinese and Indians were the result of the negotiation between UMNO,MCA and MIC and later submitted to the Reid Commission which was tasked with writing of the Malayan Constitution.
Read : http://www.tourism-melaka.com/emelakainfo/TUN%20TAN%20CHENG%20LOCK.pdf
Wonders of the internet. I even got a copy of the Reid Commission report which confirmed my statement on the negotiation of citizenship of the Chinese and Indians.
I have read the Reid Commission.Just one question to Bumiputera.
Reserve a reasonable proportion for the Malays ? Then why Uitm consists of 100% Malays?
If you cannot give a good answer, it means the Constitution has been breached and must be addressed to compensate for unfair treatment towards non Malays.
UITM was set-up under an Act of Parliament called the UITM Act,2000 under the provision of Article 153 of the Malaysian Constitution which provides for the special privileges for the Bumiputera community which includes education.
How could UITM be breaching the Constitution when its incorporation was set up under an Act of Parliament and an Article of the Constitution which is Article 153?
Everyone, I don't see a point in debating with someone who's looking to Indonesia as the model for nationalism and interracial relations. Just cease.
Coltz, you can compare with any country in the world on nationalism and inter-racial relations. The Americans scores high on nationalism but everyone speaks the same language, English whether you are Black,White,Hispanic,Asian or whatever. There still are racial discrimination in the US especially if you are coloured unless you are extremely talented like Tiger Woods (he married white), Michael Jackson(even he wanted to be white and had white surrogate mother for his sons and daughter), Michael Jordan (he too married white)and of the other white origins like German,Italian or French. Racial discrimination still exists in the US though in varying degrees with the southern states are more discriminating than the rest. There are only national schools in the US though other languages can be spoken and learned.
The same situation in Australia. The Australians are very nationalistic. They too have only national school system and everyone speaks English. They still are racial discriminations in Australia especially against Asians.
There are no perfect model country in the world . Perfect country exists only in utopia. Be grateful for the peace and relative racial harmony we enjoy in our country.
In USA there are schools using medium other than English. We are free use the languages we want. We can even home school our kids. Discrimination is illegal in America, we can bring discrimination case in the court and the law will be on our side. Everyone is equal in front of the law.
In Malaysia, racial discrimination is institutionalised, there are people that have no shame, demanding special priviledges while discrimination against not only the Malaysian Chinese, Indians, but also the natives of Sarawak ans Sabah, not to forget the Orang Asli in West Malaysia. If you want to talk about the "Son of the Soil", they were there even before the Malays. There is totally no sense of fair play.
We use English, not because we are forced to, but through which we can connect to the world and a wealth of knowledge. The world belong to all of us, we are entitled to life and responsibility as everyone else. If you can tell us what you can bring to the world to solve the problems facing humanity like, food, energy, climate change etc, may be we will consider following your footsteps. Short of which please do not hold up progess, those problems are real! Malays could get jobs in government sector and hand outs, but most of us, we have to earn a living.
Anon 9.49 is a fake American. The public school system which is decentralised is administered by each state and the medium of instruction is English. To get into college, student must sit for the SAT which is in English as the medium of instruction in universities is English. From your English, I know that you're not American.
You don't know enough about America to tell whether one is an American. America has and welcomes immigrants, with different background.
Do you know that there are many Chinese schools and other languages schools in America? When the Chinese population is small and do not have a place of their own, they can use public shool facilities for instruction?
The Chinese schools and Tamail schools in Malaysia were built mostly by the Chinese and Tamail communities. The missionaries built many schools in Malaysia too. Instead of force onto others your opinion, go build something better with your own ability. If it is good, we all can see it. You will not get respect by putting your own name on roads and schools build by others or using other's money. I know build something is a lot harder, but it is a lot more rewarding. Malaysia would be a lot better if we all try to build the best rather than forcing our ways onto others. Give and respect other's choice.
Anonymous 1.46, I studied in the US long enough to know the difference between your Malaysian English and the American English. We are discussing about the Malaysian national schools or public schools in the US. Private language schools don't count. They still have study in the public schools or private schools.
Read below on the American school system:
You will notice that it is stated that English is primary language of instruction.
Also, notice the part on English in the classroom.
Please read my earlier comments on the history of the economic migration to Malaya, the history of Malaysian independence ,the Reid Comission report and Article 153 of the Constitution to understand to present state of Malaysian society.
This was your statement.'Do you know that there are many Chinese schools and other languages schools in America?'
Bullshit. There are no vernacular schools in the US. What they have are foreign languages being taught in schools. However, the main foreign languages offered are Spanish and French.
See links below:
In fact, I would agree that the Malaysian government to study the American school system which offer foreign languages.
In the spirit of national integration, vernacular schools should be disbanded and instead national schools to offer other languages such as English,Mandarin,Tamil,Hokkien,Cantonese,Iban,Murut etc so that everyone can have the opportunity to learn another language besides Bahasa Melayu, the national language.
Obviously there is no democracy at the university and no freedom of speech nor observation of individual rights. It is this that will impede the uni from moving its aspirations forward if it continues to follow down this beaten path of failing ideology and despicable hypocracy. Its insults to both its students and staff are an insult to humanity.
HAHAHAHAHA Bumi, all your cannot answer you just try to sweep aside with calling people muddy headed.
Now ask you another, why so many Bumi scholars go overseas which does not give them special rights and not want to come back to their special rights country?
Speical rights are worse than no special rights!
Anon 9.29 , read carefully all my answers. If you cannot understand, ask someone who can.
'Now ask you another, why so many Bumi scholars go overseas which does not give them special rights and not want to come back to their special rights country?'
What kind of English is this? What 'which' are you referring to? Is it the scholarship? Is it the 'go overseas'? or is it 'not want(sic) to come back to their special rights country'?
Now I ask you why didn't most Chinese in Malaya, who were not British subjects, return to China when the option was given upon Britain's intention to grant independence to Malaya but instead get MCA to negotiate with UMNO for citizenship?
There are many Chinese schools like this in USA.
When these schools were first established, they were offered the use of public school facilities. Then, some school districts offered Chinese classes in school, then Chinese imersion programs. AP exam in Chinese were then introduced. Many examples of using public facilities to facilitate the formation of Chinese Schools. In Malaysia, the Chinese and Tamil schools were build by the community, and the government is trying to take away from the community.
In US schools and universities, when we talk about moral and justice, it is this:
and not the discriminatory brain washing. Our kids can concentrate to learn real skills and respect each other. Hence, the Chinese Schools do not have to duplicate what is taught in public schools. In Malaysia, you have eliminated many English School options too. What you are doing is making Malaysia non competitive. When the natural gas (a lot from Bintulu) and oil run out, our forest baren, the Chinese and Indians non competitive, what/whom are you going to depend on to support your special privileges.
You do not need to sit for SAT to gain admission to US Universities. There is ACT, so SAT is not a monopoly.
There is no doubt that you have studied in US, there are many things happening in USA, but the most important thing is be fair and every one is equal in front of the law. The government's job is to create a level playing field, not the distorted one you are advocating. You seem to have missed the most important point on the founding of America.
If you want to talk about agreement made during the formation of Malaysia, please read the following post. You have not only abused the people of West Malaysia, worst towards the people of East Mayaysia.
The agreement was written for the main purpose of safeguarding the interests, rights, and the autonomy of the people of Sabah upon the formation of the federation of Malaysia. It was originally envisaged that Sabah be one of the four entities in the federation, the others being Malaya, Singapore, and Sarawak. However as times passed, Sabah and Sarawak has ended up being merely one of the 13 states in the federation.
The position today
There has been numerous calls for the agreement to be reviewed to take into account social, economic, and political
changes over time.
Point 1: Religion
While there was no objection to Islam being the national religion of Malaysia there should be no State religion in North Borneo, and the provisions relating to Islam in the present Constitution of Malaya should not apply to North Borneo.
Point 2: Language
a. Malay should be the national language of the Federation.
b. English should continue to be used for a period of 10 years after Malaysia Day.
c. English should be an official language of North Borneo for all purposes, State or Federal, without limitation of time.
Point 3: Constitution
Whilst accepting that the present Constitution of the Federation of Malaya should form the basis of the Constitution of Malaysia, the Constitution of Malaysia should be a completely new document drafted and agreed in the light of a free association of states and should not be a series of amendments to a Constitution drafted and agreed by different states in totally different circumstances. A new Constitution for North Borneo (Sabah) was of course essential.
Point 4: Head of Federation
The Head of State in North Borneo should not be eligible for election as Head of the Federation.
Point 5: Name of Federation
“Malaysia” but not “Melayu Raya”.
Point 6: Immigration
Control over immigration into any part of Malaysia from outside should rest with the Central Government but entry into North Borneo should also require the approval of the State Government. The Federal Government should not be able to veto the entry of persons into North Borneo for State Government purposes except on strictly security grounds. North Borneo should have unfettered control over the movements of persons other than those in Federal Government employ from other parts of Malaysia into North Borneo.
Point 7: Right of Secession
There should be no right to secede from the Federation.
Point 8: Borneanisation
Borneanisation of the public service should proceed as quickly as possible.
Point 9: British Officers
Every effort should be made to encourage British Officers to remain in the public service until their places can be taken by suitably qualified people from North Borneo.
Point 10: Citizenship
The recommendation in paragraph 148(k) of the Report of the Cobbold Commission should govern the citizenship rights in the Federation of North Borneo subject to the following amendments:
a) sub-paragraph (i) should not contain the proviso as to five years residence.
b) in order to tie up with our law, sub-paragraph (ii)(a) should read “7 out of 10 years” instead of “8 out of 10 years”.
c) sub-paragraph (iii) should not contain any restriction tied to the citizenship of parents – a person born in North Borneo after Malaysia must be federal citizen.
Point 11: Tariffs and Finance
North Borneo should retain control of its own finance, development and tariff, and should have the right to work up its own taxation and to raise loans on its own credit.
Point 12: Special position of indigenous races
In principle, the indigenous races of North Borneo should enjoy special rights analogous to those enjoyed by Malays in Malaya, but the present Malays’ formula in this regard is not necessarily applicable in North Borneo.
Point 13: State Government
a) the Prime Minister should be elected by unofficial members of Legislative Council.
b) There should be a proper Ministerial system in North Borneo.
Point 14: Transitional period
This should be seven years and during such period legislative power must be left with the State of North Borneo by the Constitution and not be merely delegated to the State Government by the Federal Government.
Point 15: Education
The existing educational system of North Borneo should be maintained and for this reason it should be under state control.
Point 16: Constitutional safeguards
No amendment modification or withdrawal of any special safeguard granted to North Borneo should be made by the Central Government without the positive concurrence of the Government of the State of North Borneo. The power of amending the Constitution of the State of North Borneo should belong exclusively to the people in the state.
(Note: The United Party, The Democratic Party and the Pasok Momogun Party considered that a three-fourth majority would be required in order to effect any amendment to the Federal and State Constitutions whereas the UNKO and USNO considered a two-thirds majority would be sufficient).
Point 17: Representation in Federal Parliament
This should take account not only of the population of North Borneo but also of its seize and potentialities and in any case should not be less than that of Singapore.
Point 18: Name of Head of State
Yang di-Pertua Negara.
Point 19: Name of State
Point 20: Land, Forests, Local Government, etc.
The provisions in the Constitution of the Federation in respect of the powers of the National Land Council should not apply in North Borneo. Likewise, the National Council for Local Government should not apply in North Borneo.
Similar agreement was written for Sarawak too.
What I don't understand about these people is that if they are so pissed off with this country why don't they just migrate elsewhere where they think they would be better treated? Remember also to relinquish their citizenships. There were a lot of Chinese Malaysian who migrated to Australia but would not relinquish their Malaysian citizenships but continue to badmouth Malaysia.
Have you read the link you've provided i.e. http://www.bcs-usa.org/
Don't you understand that Berryessa Chinese School is a Chinese language school which Chinese American can learn the Chinese language and culture. Is it NOT a Chinese medium school like our Chung Hwa High School,Lai Meng or Kuen Cheng in which all subjects are taught in Chinese.
The Chinese school in US only teaches Chinese language and culture. I believe Chinese medium school are not allowed to be set up in the US as it would be against its national education policy. Students would still have to attend a normal school whether private or public. Do you now see the difference between a Chinese school in Malaysia and in the US?
BTW why don't you guys used pseudo names instead of Anonymous? There are so many anonymouses. What are these people afraid of?
You only took a certain part of the Constitution and ignore other parts.
The Constitution also states the legitimate interests of other communities must be safeguarded.
Only certain proportion is reserved for Bumiputera.
When something is given 100% to Bumiputera, how to safeguard the legitimate interests of other communities?
Your argument is more flawed .In the past ,Maktab Mara only accepted Bumiputera.Only after the policy was critised by a former prime minister, does it begin to accept non Bumiputera.
Anonymous 3.07, the special privileges of the Bumiputeras under Article 153 of the Constitution must be looked in totality not in bits and pieces. Just like when you buy a car , you want a whole car not a half-car that would not function. Likewise, to assist Bumiputeras in training and education, they must be provided with a whole institution not half of an institution . The institution that is entrusted to uphold the objective of training Bumiputera in this case is the Majlis Amanah Rakyat (MARA).
At the same time, the rights of the other citizens have not been deprived. Are the other citizens being prohibited to enrol in schools and colleges? Are the other citizens being prohibited to participate in the political process? Are the other citizens being prohibited to acquire wealth?
With the exception of the special privileges for Bumiputeras under Article 153 of the Constitution, what rights of the other citizens that are being deprived?
Of course I understand what is happening in Chinese Schools in America, in Malaysia and English Schools in Malaysia. What I was trying to tell you is, in other countries, people were helping to build up institutions started by the grass roots. Where as, you trying to destroy institutions build up by the grass roots. More over, the (e.g. Mission) schools and universities (e.g. UM) taken over by MOE were getting worst under their supervision instead of getting better relative to other schools and universities. Now, you want to take over everything!? The incompetence should lean how to do a good job on what they have first and, even the Mission Schools should be taken away from them so that we can stop the bleeding.
50 years ago, Malaysia was more open, but now the West has been a lot more open.
You keep on talking about the agreement led to the fomation of Malaysia, that is why I posted the agreement written at that time. Please read carefully and see what happen during the last few decades under UMNO.
You have no right to ask another Malaysian to get out of Malaysia when he/she points out the abuse you and your cronies have inflicted. I am part of the party that led to the formation of Malaysia, when you are doing great harm to the country, hence all of us, we have the duty to point it out and stop it.
Hello... Just pointing out something... I am actually a student in UM. I observe the thing that really keeps people apart here is the languages. Most people here are segregated to what language they prefer. Most people don't want to get out of this comfort zone. Rarely is effort made to break this segregation.
And as for the "Malays snubbing the other races"... Most people don't DO that. But some people do. And they're not all just Malays. Chinese and Indians do it to other races too.
And a lot of people in UM are really there to study. Not to get involved in politics. So, strangely enough, the students are largely indifferent to all this mess.
'In USA there are schools using medium other than English. We are free use the languages we want.' This is what you wrote on 10/21/2009 09:49:00 AM .
'There are many Chinese schools like this in USA.
http://www.bcs-usa.org/'This is what you wrote on 10/22/2009 11:25:00 AM.
From the above statements, you were trying to imply that there are Chinese medium schools in the US when they were merely language schools.
I don't know what is your problem but from your previous statements I am assuming that you are ethnic Chinese Sabahan. Not too sure whether you are Bumiputra or not but you seem very upset with the Federal government for some reasons or other.
I've never wrote anything on the agreement which led to the formation of Malaysia. As a Sabahan you are more interested in this agreement. But I was referring to the Reid Commission Report which discussed the independence of Malaya NOT the formation of Malaysia or the 20-points agreement between Sabah and Malaya.
On the state of affairs in Sabah were mainly due the weaknesses of the Sabahan state government. There were a lot of things that federal government tried to assist the state government but because of the 20-points agreement in the Malaysia Agreement, the state government always resisted interference in the state administration e.g. land development .
Regarding my advice to those who despise Malaysia to leave the country, I am referring to the immigrant race who were granted citizenship of Malaya upon its independence. Chinese(except the Peranakan Chinese who were considered British subjects)and Indians were not citizens before Malaya's independence. They have accepted the conditions of being granted citizenship in the form Article 153 of the Federal Constitution.
You are pretty judgemental, aren't you. You even claim that you were a party that led to the formation of Malaysia. Are you Tan Sri Datuk Amar Stephen Kalong Ningkan?
You tried to avoid my question"how the legitimate interests of other communities are safeguarded when something is given 100% to bumiputera".The Constitution states very clearly only proportion deemed reasonable is given to Bumiputera.Or you do not understand the meaning of "proportion"?
Makatb Mara have accepted non Bumiputera.Have any Maktab Mara closed shop or collapsed?
"Are the other citizens being prohibited to enrol in schools and colleges?"
The right to get education is basic human right. We do not need to ask license from Bumiputera to get education.Bumiputera do not have right to prohibit us from getting education.
"Are the other citizens being prohibited to participate in the political process?"
When we participate in Malaysia politics, you Bumiputera seem to be unhappy that we have political rights.Yet you still call us "citizens". When we do not participate in Malaysia politics, you Bumiputera would accuse us of being unpatriotic citizens who care about China or India only.
"Are the other citizens being prohibited to acquire wealth? "
We are human beings. We need to earn money to buy food and houses.
If we do not earn money ,would you give us food and houses?
Next time maybe you would ask non Bumiputera to be grateful because non bumiputera are not prohibited from sleeping/eating/sweating//driving cars and so on.
I have to agree with Coltz. There is no point arguing with somebody who regards Indonesia as a role model.
Anon 10.40 am (Don't know why you cannot select a pseudo name), Here is an extract of the Constitution.
Article 153(2) Notwithstanding anything in this Constitution, but subject to the provisions of Article 40 and
of this Article, the Yang di-Pertuan Agong shall exercise his functions under this Constitution
and federal law in such manner as may be necessary to safeguard the special provision of the
Malays and natives of any of the States of Sabah and Sarawak and to ensure the reservation for
Malays and natives of any of the States of Sabah and Sarawak of such proportion as he may deem
reasonable of positions in the public service (other than the public service of a State) and of
scholarships, exhibitions and other similar educational or training privileges or special facilities
given or accorded by the Federal Government and, when any permit or licence for the operation
of any trade or business is required by federal law, then, subject to the provisions of that law and
this Article, of such permits and licences.
'You tried to avoid my question"how the legitimate interests of other communities are safeguarded when something is given 100% to bumiputera".'
I've explained on 10/22/2009 04:16:00 PM.
The proportion is a proportion of a whole. For example, if there are 10 universities in Malaysia,it cannot be a situation where ALL the universities are reserved for Bumiputras.
MRSM merely exercised its indulgence in offering 10% of the students to non-Bumi which does not compromise the Bumi special rights.
'I have to agree with Coltz. There is no point arguing with somebody who regards Indonesia as a role model.'
As I've explained on 10/21/2009 09:10:00 AM
BTW have you read the news article on 10/23/2009 04:13:00 PM ? It is an excellent suggestion by a prominent non-Bumi Malaysian professor of history at the University of Malaya. As a Malaysian, I hope you can read and understand Bahasa Melayu. There are a number of my non-Bumi friends who cannot understand Bahasa Melayu and needed me to translate letters in Bahasa Melayu to them. What a shame and very unMalaysian. Compare that to USA,Australia,UK where everyone understand English the national language.
I see. I thought some very major and fundamental terms have to be reviewed and agreed again 15 years after Independence as required by the agreement for the granting of independence. It would appear that the reviews have been hijacked and more crutches have been put in place instead. These crutches have since become permanent in perpetuity and there is to be no arguements about it. North Borneo and Sarawak are each supposed to be the equals to Malaya but instead, we got hoodwinked and became downgraded to the status of a minor Malayan state instead when we are in fact larger and richer. And our resources have been siphoned off for the benefit of Malaya.
If given a chance, I think both Sabah and Sarawak would prefer to go our own ways but that would be illegal now as we cannot secede and would require the consent of all the Malayan states and the Federal government.
That's about the situation I think. Is it fair for Malaya to boss over Sabah and Sarawak? Why dont you go and mind your own business and we, ours?

Malaysians deported after failing to seek asylum
Sunday, October 25th, 2009 16:24:00
Malaysians were among those deported after failing to seek asylum as 'refugees' in Australia last year.
They had earlier arrived by plane and sought refuge in the country. The other non-genuine refugees comprised those from Indonesia, India and China.
The Chinese represented 30 per cent of those who applied for refuge, followed by Sri Lankans (eight per cent), Malaysians, Indonesians, Iraqis and Indians.
Daily, at least 13 asylum-seekers enter Australia through airports, representing 30 times the number of boat people supposedly "flooding" across our maritime borders, reports the Sunday Telegraph.
A total of 4,768 'plane people' -- more than 96 per cent of applicants for refugee status -- arrived by aircraft last year, on legitimate tourist, business and other visas as compared to 161 who arrived by boat during the same period, the newspaper said.
Furthermore, 'plane people' are much less likely than 'boat people' to be genuine refugees, with only about 40-60 per cent granted protection visas, as compared with 85-90 per cent of boat people found to be genuine refugees.
Between 2007 and last year, 3,987 claims were received, of which, 1,930 were approved. While 'boat people' are detained on Christmas Island and their claims processed, 'plane people' live in the community and are allowed to work under policy changes introduced by the Rudd government, the newspaper said.
Experts told the newspaper that few Australians understand 'boat people' represent just a small fraction of our refugee intake -- and these asylum-seekers are unfairly vilified by "expedient" politicians.
Australia will take 13,750 refugees through its humanitarian programme in 2009-10, an increase of 250, as compared to last year.
DO YOU THINK THE MALAYSIAN GOVERNMENT SHOULD TAKE BACK MALAYSIANS LIKE THESE?
Best students will get to further education at top varsities
Summary: 30 of the country’s creme de la creme students will be awarded National Scholarships strictly based on merit, which will allow them to further their education in world-renowned universities.
What is meaning of "world renown university"?
UM also very world reknown. Count or not?
From The Free Dictionary.com
Definition of : world-re·nowned (wûrldr-nound)
Widely known and acclaimed.
With due respect to our UM, is our UM widely known and acclaimed? I believe widely and acclaimed means in the world not locally or regionally. How many of its professors and student or ex-students are Nobel Prize winners?
